1. Scope
These Terms of Use (the “Terms”) govern your use of the Wheel SS app (the “App”) and its related website, both provided by IDEA-RING Inc. (“we,” “us,” or “our”).
By using the App, you confirm that you have read and accepted these Terms. If these Terms conflict with the terms of the App Store or Google Play, the applicable store terms will control matters relating to that store.
2. Purpose and Features of the App
The App is intended for entertainment and casual, everyday decision-making. It displays the entries you create as a roulette wheel and lets you edit entries, colors, weights, spin and stop effects, history, favorites, replays, and other settings.
The App includes Star Dial, which can alter drawing probabilities, wheel movement, pre-result effects, result displays, and the flow of a redraw. Available features may vary by device, operating system, region, purchase status, or App version.
3. Draw Results and the Nature of Star Dial
Results are determined by the weight assigned to each entry, your settings, the Star Dial features selected, pseudorandom values, the state of the App at the time of the draw, and other in-app logic. Star Dial includes features designed to influence ordinary probabilities or how a result appears, including making an entry more likely to win, avoiding an entry, setting a sequence of results, or showing a different result after a temporary result.
The App therefore does not guarantee a draw based on physical randomness or cryptographically secure randomness, an independently audited draw, fairness toward third parties, complete unpredictability, or that any particular result will or will not occur.
4. Your Responsibility
You are responsible for your settings, your use of the App, and your decision whether to rely on a result. When using the App with other people, especially when Star Dial may affect the result, explain what is appropriate for the situation and obtain any necessary consent.
Do not use the App for any of the following:
- Misrepresenting a draw as fair or independent in order to deceive or disadvantage another person
- Gambling or wagering money, property, or anything that can be exchanged for value
- A draw that must be fair or independently verifiable under law, contract, or event rules
- Decisions affecting employment, admission, credit, insurance, healthcare, legal or financial matters, safety, legal rights, or other significant interests
- Decisions that may seriously affect a person’s life, health, safety, or property when based solely on an App result
5. In-App Purchases
Some Star Dial features can be unlocked through a one-time in-app purchase. This is not a subscription. The price, taxes, currency, offer terms, and any promotion shown on the purchase screen at the time of purchase will apply.
Purchases, billing, refunds, and restoration are governed by the terms of the App Store or Google Play used for the transaction. A purchase may be restored only within the same store account and to the extent that store permits. Purchases cannot be transferred between different stores or platforms.
A purchase includes the locked features offered with the product at the time of purchase and locked Star Dial features added in the future at no extra charge. This does not guarantee that the App will remain available indefinitely, that every feature will always be maintained, or that it will continue to work on every device.
6. Data Stored on Your Device
Your wheels, history, favorites, Star Dial settings, and other settings are generally stored on your device. They may be lost because of device failure, changing devices, deleting the App, operating-system changes, or other circumstances. Do not use the App as the only place to keep important information.
7. Prohibited Conduct
You must not engage in any of the following when using the App or its website:
- Violating any law, public policy, accepted standards of conduct, or these Terms
- Engaging in or encouraging fraud, threats, harassment, discrimination, gambling, or other unlawful conduct
- Infringing our rights or the rights of another person, including intellectual property, privacy, or reputation rights
- Accessing or modifying the App without authorization, placing an excessive load on it, disrupting its operation, or bypassing security features
- Analyzing, decompiling, or reverse engineering the App beyond what applicable law permits
- Any other conduct we reasonably consider inconsistent with the purpose of the App
8. Intellectual Property
All rights in the software, design, images, text, audio, trademarks, and other content included in the App and its website belong to us or their lawful owners. Permission to use the App under these Terms does not transfer any of those rights to you.
9. Changes, Suspension, or Discontinuation
We may change, suspend, or discontinue all or part of the App when reasonably necessary for maintenance, service failures, security, legal compliance, changes to operating systems or store requirements, or similar reasons. We will try to give advance notice where practical, except in urgent situations.
10. Disclaimers and Limitation of Liability
We do not promise that the App will meet a particular purpose, always be accurate or complete, operate without interruption, preserve all saved data, or work on every device. Disputes between users, or between a user and another person, concerning App settings, draw results, the way results are presented, or the use of the App must be resolved by those parties.
Except in cases of our willful misconduct or gross negligence, we are not liable for indirect or special loss, lost profits, or other loss that would not ordinarily and directly arise from using the App. Where consumer-protection law or another mandatory rule does not allow all or part of this limitation, that law will apply instead.
11. Changes to These Terms
We may update these Terms when a change benefits users generally, or when it is reasonable in light of the need for the change, the appropriateness of the revised terms, and other relevant circumstances. We will give advance notice of material changes and their effective date through the website or the App.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of Japan. To the extent permitted by law, the Osaka District Court or Osaka Summary Court will have exclusive jurisdiction as the court of first instance over disputes relating to the App or these Terms. Nothing in this section limits mandatory rights available under the law of your place of residence.
